This privacy notice aims to give you information on how we collect and process your personal data generally and through your use of our website, including any data you may provide through our website when completing the ‘Contact Us’ form.

Our website is not intended for children, and we do not knowingly collect data relating to children.

This Privacy Notice applies to personal data processed through all websites owned and operated by the H.B. Fuller Company, located at 1200 Willow Lake Ave, Vadnais Heights, Minnesota 55110 in the United States (“H.B. Fuller Company”), unless otherwise noted through a separate privacy policy (the “Websites”). This Privacy Notice also applies to personal data collected from you offline, in-person, for example, if you provide us your business card at a trade show. Finally, this Privacy Notice applies to personal data, if any, processed in relation to our business relationship with you, for example, your business contact information or your purchasing credentials.

The data controller for your personal data is the local H.B. Fuller affiliate that you have contacted (“H.B. Fuller,” “we," or “us”). You can find the contact information for H.B Fuller affiliates here. H.B. Fuller Company operates the Websites and customer relationship management database (described below) to assist local H.B. Fuller affiliates in serving you.

The goal of this Privacy Notice is to inform you of the online and in-person, offline privacy practices of H.B. Fuller regarding your personal data and to describe the choices you have about the way such personal data is used. “Personal data” means information that relates to you as an individually identifiable person, such as your name, e-mail address, and mobile number.

3. Your Consent
If you do not consent to H.B. Fuller handling your personal data as described in this Privacy Notice, please do not use the Websites or directly provide personal data to H.B. Fuller.  If you reside outside of the United States, you will not be able to submit personal information through the Websites unless you consent to the processing of your personal data as described in this Privacy Notice. 

4. Your Information 
H.B. Fuller’s primary goals in collecting information about you are to facilitate your access to information about the Company's products and services relevant to you and to give you a meaningful, enjoyable, and personalized website experience. Personal data also allows us to provide better service to you by tailoring our communications to match your interests – to deliver more of what you want and less of what you don’t want. If you do not provide your personal data, we may not be able to provide a personalized experience or provide services you request.

Here are the categories of personal data we gather:

  • Personal Data You Explicitly Provide: You will be asked to provide personal data when you submit through the Websites a request for information. If you wish to purchase products or services from one of the Websites, you will be prompted to authenticate to make a purchase, submit an order or view details about a previous order. H.B. Fuller will be able to identify you based upon the information or credentials that you enter. You also may provide your personal data to us in person by filling out a survey at a trade show or giving us your business card in a meeting. You can choose not to provide information or credentials, but then you might not be able to obtain some of our products, services or offerings. Categories of personal data that you may explicitly provide include the following:
    • Identifiers, for example: real name, telephone number, postal address, and e-mail address.
    • Commercial Information, for example: records of products or services purchased, warranty registrations, and purchasing or consuming histories.
    • Internet or Other Electronic Network Activity Information, including: unique device identifiers, dynamic and static Internet Protocol (“IP”) Please see the section below entitled “Information Sent To Us By Your Internet Web Browser.”
    • Sensory or Surveillance Data, for example: voicemails and recordings as described above in “User Content”, and video surveillance footage if you visit any of our physical facilities. This may also include recordings you create, including audio recordings or voicemail you submit in connection with customer service.
    • Professional Information, for example: business contact information and job title.
    • Inferences, for example: H.B. Fuller might infer based on your purchase history that you would be interested in purchasing other products or services.
    • Other Personal Data:
      • Financial Information, for example: payment card details, billing address, and shipping address.
      • User Content, including content you submit when you contact customer service or otherwise contact H.B. Fuller.  
      • Communications Data, for example: during our communications with you, we collect the content of these communications as well as metadata about the communications, i.e., date and time of the call or text (SMS or MMS) message and phone numbers.

 
Cookies: H.B. Fuller uses cookies on the Websites in order to make the Websites work, or work more efficiently, as well as to provide web services and functionalities for users. For more information (including about the type of information gathered by means of cookies as well as the purposes of our use of such information), please see the H.B. Fuller Cookie Policy by clicking here. This section on cookies does not apply to in-person offline data collection.
Information Sent To Us By Your Internet Web Browser: H.B. Fuller collects information that is automatically sent to us by your browser. This typically contains your IP address (or the IP address of your firewall or Internet Service Provider), the name of your Operating System (OS X®, IOS®, Windows®, Linux®, etc.), and the name and version of your browser (Internet Explorer®, Google Chrome™, Safari®, Firefox®, etc.). We do not link your personal data to your IP address. Where, according to local law, IP addresses and the like are considered personal data, we treat them as such. The information that we receive is dependent upon your browser settings. For more information about these settings, please see the help pages for your specific browser. H.B. Fuller will use this information to create statistics that will help with the design of the Websites. This section also does not apply to in-person offline data collection.


Children’s Online Privacy Protection Act Compliance

We do not collect information from anyone under 13 years of age.  The products and/or services we provide, together with the Websites, are all directed to individuals who are at least 13 years old.  If you are under the age of 13, you are not authorized to use our services or the Website.

5. Using Your Information 
H.B. Fuller uses your personal data for the following purposes:

  • To create and maintain customer, supplier and/or distributor accounts;
  • To authenticate your access to your customer, supplier and/or distributor account;
  • To provide you with information you request;
  • To respond to your queries;
  • To better understand your needs and interests and to personalize communications;
  • To develop new products and services and to improve our existing products and services,
  • To send you information about our products and services, to the extent permitted by law;
  • As applicable, to process, fulfill and follow up on product orders;
  • To provide you with information related to your client, supplier and/or distributor account, and the products or services you purchased from us;
  • To respond to your inquiries about becoming a distributor for H.B. Fuller and, if your company does become a distributor, to maintain the business relationship;
  • To maintain a customer relationship management database to manage business contact information for clients, potential clients, suppliers and distributors along with other information related to the business relationship;
  • To administer the Websites (including troubleshooting, data analysis, testing, system maintenance, support, reporting and hosting of data);
  • With respect to information collected by cookies, to facilitate your use of the Websites, analyzing usage by visitors, and improving user experience;
  • To comply with legal requirements or a court order;
  • To assist with investigation(s) in the event of actual or suspected fraud, security incident, and/or criminal act, such as identity theft, or other misconduct; and/or
  • In connection with the sale, merger, acquisition, purchase, or reorganization of H.B. Fuller.

Marketing and advertising: If you express an interest in our products and services, we may use your personal data, as necessary, to provide you, in accordance with applicable law, with information about the products and services that we think might interest you. We also use this data to conduct market research and to improve our marketing strategies. See also Section 8 on how to opt-out of marketing communications.

Legal Basis: As noted above, H.B. Fuller processes your personal data for the purposes described above with your consent.  To the extent you provide us with your personal data, H.B. Fuller will also process your information as necessary to: (i) fulfil our contractual obligations to you in the event you are a sole proprietorship, for example, to send you transactional information about your purchases; (ii) fulfill our legitimate interests, such as to manage business operations, marketing and advertising, and/or to conduct investigations as described above; and/or (iii) satisfy legal obligations, such as to maintain certain financial records.

6. The Sources From Which We Collect Your personal Data
We may collect your Personal Data from any of the following categories of sources:

  • You, for example, when you register with our Site, register for an event that we sponsor, or when you otherwise provide information directly to us.
  • Service providers, for example, analytics providers.
  • Affiliated companies, for example, so that we can assist other companies in H.B. Fuller’s international organization to provide you with products or services.
  • Automated technologies, for example, browsing activity collected by automated technologies on the Site.
  • Third parties, for example, lawyers, bankers, auditors, and insurers who provide consultancy, banking, legal, insurance, and accounting services.
  • Public sources, for example, public databases.
  • Marketing/advertising companies, for example, from social media platforms, consumer research companies, and analytics or marketing/advertising companies.
  • Surveillance/recording technologies installed by Company, for example, video surveillance in common areas of Company facilities, voicemail technologies, and audio recording technologies with consent to the extent required by law.
  • Government or administrative agencies, for example, law enforcement, public health officials, and other government authorities.
  • Acquired entity, if Company acquired another entity, Company might collect personal information from that entity. 
  • Other sources.

7. Does H.B. Fuller Disclose Your Personal Data? 
H.B. Fuller will not sell your personal data to any third-party vendor or business. H.B. Fuller will disclose your personal data to third parties only to the extent that your personal data is used for the purposes described in this Privacy Notice. In all cases, your personal data will be used in a manner consistent with this Privacy Notice.

The following are the ways in which we disclose your personal data:

  • Affiliated Companies: H.B. Fuller discloses your personal data with H.B. Fuller Company (the parent corporation located in the United States). H.B. Fuller Company manages the Websites and handles your personal data for the purposes described in Section 5 above. H.B. Fuller and H.B. Fuller Company may also share your personal data with other companies in the H.B. Fuller family of companies as necessary to respond to your requests.
  • Third-Party Service Providers: We will disclose your personal data with third-party service providers under contract with H.B. Fuller and H.B. Fuller Company to help us provide services to you. The following are some of the types of third-party service providers with which we disclose your personal data and our purpose for doing so:
    • Data Analytics: We retain third-party service providers to help us perform data analytics regarding your interactions with the Websites.
    • Communications Service Providers: Service providers assist us in sending you communications using your personal data, such as emails, mail through the postal service, and telephone calls.
    • Legal Advice: We may disclose your personal data to an attorney in the process of obtaining legal advice.
    • Customer Relationship Management Providers: We disclose your personal data to service providers that host and service our customer relationship management database so that we can effectively manage our relationship with you and with your company.
    • Enterprise Resource Planning Providers: We disclose your personal data to service providers that host and service our enterprise resource planning database and systems. These service providers assist us in efficiently administering business operations and customer support, particularly by facilitating information flow within H.B. Fuller.
    • Administrative Services Providers: We disclose personal data to administrative services providers, such as accountants, in order to manage our business operations.
    • Advertising Platforms: We may disclose the fact that you visited the Websites to advertising networks so that they can show you H.B. Fuller advertisements on other websites and platforms. These services can help us tailor advertising that we think may be of interest to you based on your use of the Websites and to otherwise collect and use data about your use of the Websites.

We require these third-party service providers, by written agreement, to provide safeguards for your personal data similar to the ones that we provide.

  • Required Disclosures: We may be required to disclose personal data in a court proceeding, in response to a court order, subpoena, civil discovery request, other legal process, or as otherwise required by law.
  • Legal Compliance and Protections: We may disclose account and other personal data when we believe disclosure is necessary to comply with the law or to protect the rights, property, or safety of H.B. Fuller, our users, or others. This includes exchanging personal data with other companies and organizations for fraud protection and credit risk reduction.
  • Corporate Transactions: We reserve the right to disclose and transfer your data, including your personal data:
    • To a subsequent owner, co-owner, or operator of the Websites or successor database.
    • In connection with a corporate merger, consolidation, the sale of substantially all of our membership interests and/or assets or other corporate change, including to any prospective purchasers.

8. Your Choices about Receiving E-mail from H.B. Fuller 
H.B. Fuller may send you e-mails about your requests, orders or account and in response to your questions.

H.B. Fuller also may send you e-mails with information and/or special offers about products and services that may be of interest to you, provided that you granted your consent to the receipt of such emails where required by law.  Promotional e-mail that you receive from H.B. 9. Protecting and Retaining Your Personal Data  
H.B. Fuller implements a variety of administrative, managerial and technical security measures to help protect your personal data. H.B. Fuller has Internal Control Standards, which relate specifically to the handling of personal data. These include certain controls to help safeguard the information we collect online.

H.B. Fuller employees are trained to understand and comply with these controls, and we communicate our Privacy Notice, practices and guidelines to our employees. However, while we strive to protect your personal data, you also must take steps to protect your information. We urge you to take every precaution to protect your information while you are online.

H.B. Fuller will keep your personal information only for as long as reasonably necessary to fulfil the purposes for which we collected it, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal information for longer to resolve any disputes or in the event of litigation. However, in certain circumstances, you may request that we delete your personal information by submitting a request as described below.

10. Links to Other Websites and Plug-ins 
The Websites contain links to other websites and social media channels not owned or operated by H.B. Fuller. These links are provided as a service to visitors to the Websites and do not contain any endorsement of the products offered or opinions expressed by these sites. H.B. Fuller does not control these sites and is not responsible for their content, security and privacy practices. H.B. Fuller encourages you to ascertain the privacy practices of those websites before providing any personal data to them.

11. Keeping Your Personal Data Accurate  
If you have an account, you can access, review, and update your account profile using your user name and password. You can also contact your usual local customer service person, or email Data_Privacy@hbfuller.com. Additional actions in relation to your personal data may be available to you as described in Section 13(d) and 14(c)below.

13. Information Specific to California Residents
This section of the Privacy Notice applies only to individuals who are residents of the state of California in the United States and only when H.B. Fuller processes their Personal Data subject to the California Privacy Rights Act (CPRA).

  • Notice at Collection for California Residents
    • H.B. Fuller collects the personal data identified in Section 4 of this Privacy Notice, for the purposes identified in Section 5, and retains it for the period described in Section 9. We do not sell your personal data or disclose it for cross-context behavioral advertising (“sharing”).  We also do not collect or process sensitive personal information for the purpose of inferring characteristics about you. To the extent you provide H.B. Fuller with personal data about other California residents, you are responsible for providing this notice to them.
  • Disclosures for Business Purposes
    • H.B. Fuller may disclose the categories of personal data described in Section 4 of this Privacy Notice, to the categories of third-party recipients listed below for the following “business purposes” (as defined by the CPRA), in addition to the purposes identified in Section 5:
      • Affiliated Companies. We may disclose your personal data to other companies within the H.B. Fuller family of companies for the business purposes of (a) auditing compliance with policies and applicable laws, (b) helping to ensure security and integrity, (c) debugging, (d) short-term transient use, (e) internal research, (f) activities to maintain or improve the quality or safety of a service or device, and (g) performing services on Hyland’s behalf.
      • Third-Party Service Providers. We may disclose your personal data to the types of service providers listed in Section 6, above, so that they may perform services on our behalf.
      • Professional Services Providers. We may disclose your personal data to these service providers, including lawyers, accountants, and consultants, for the business purposes of auditing compliance with policies and applicable laws, in addition to performing services on Hyland’s behalf.
  • No Sale or Sharing
    • We do not sell or share your personal data where “share” means disclosing personal data to third parties for cross-context behavioral advertising. Without limiting the foregoing, we have no actual knowledge that we have sold or “shared” the personal data of individuals of any age, including the personal data of children under 16, in the last 12 months and do not intend to do so.
  • Your California Privacy Rights
    • Subject to applicable limitations and exceptions, California residents have the following rights under the CPRA:
      • Right to Know: You have the right to submit a verifiable request for specific pieces of your personal data obtained from or about you and for information about H.B. Fuller’s collection, use, and disclosure of your personal data. Please note that the CPRA’s right to obtain “specific pieces” does not grant a right to the whole of any document that contains personal data, but only to copies of items of personal data. Moreover, California residents generally just have a right to know categories, for example, categories of third parties to which personal data is disclosed, but not the individual third parties.
      • Right to Delete: You have the right to submit a verifiable request for the deletion of personal data that H.B. Fuller obtained from you.
      • Right to Correct: You have the right to submit a verifiable request for the correction of inaccurate personal data maintained by H.B. Fuller, taking into account the nature of the personal data and the purposes of processing the personal data.
    • How to Exercise Your Rights
      • H.B. Fuller will respond to requests to know, delete, and correct in accordance with the CPRA if it can verify the identity of the individual submitting the request. You can exercise these rights in the following ways:

    • How We Will Verify your Request
      • If you submit a request through an adequately secure password-protected account that you created before the date of your request, we will use the authentication mechanisms in the account to verify your identity.  Otherwise, we match personal data that you provide us against personal data we maintain in our files.  The more risk entailed by the request (e.g., a request for specific pieces of personal data), the more items of personal data we may request to verify your identity.  If we cannot verify your identity to a sufficient level of certainty to respond securely to your request, we will let you know promptly and explain why we cannot verify your identity.
    • Authorized Agents
      • You may designate an authorized agent to exercise your right to know, to correct, or to delete. If an authorized agent submits a request on your behalf, the authorized agent must submit with the request another document signed by you that authorizes the authorized agent to submit the request on your behalf.  In addition, we may ask you or your authorized agent to follow the applicable process described above for verifying your identity. You can obtain the “Authorized Agent Designation” form by contacting us at Data_privacy@hbfuller.com.
  • H.B. Fuller’s Non-Discrimination Policy
    • H.B. Fuller will not unlawfully discriminate against you for exercising your privacy rights described in this Privacy Notice.

14. Information Specific to Non-U.S. Users  
 

  • International Data Transfers

The personal data collected through the Websites and collected offline in-person will be transferred to H.B. Fuller Company in the United States. H.B. Fuller Company will use the personal data for the purposes described above in Section 5 and to forward any requests you submit to appropriate affiliated companies, such as the H.B. Fuller affiliate local to you. In addition, H.B. Fuller’s affiliated companies may on occasion access your personal data to assist in responding to your requests, for example, about a product produced by that affiliated company. H.B. Fuller’s affiliated companies are located around the world in countries that may provide a different level of protection than your country of residence. The locations of the affiliated companies are listed here.  

Affiliated companies will be permitted access to your personal data only if they take steps to provide an adequate level of protection for that information.  Before transferring your personal data directly to any third-party service provider identified in Section 6 above, located in the United States or another third country, H. B. Fuller will confirm that all necessary data transfer requirements have been satisfied.

If you reside in a country that restricts cross-border data transfers, H.B. Fuller relies on your consent for the transfer of your personal data outside your country of residence and within the H.B. Fuller corporate group or to third-party service providers unless an alternative or additional data protection mechanism is required by applicable law.

  • Automated Decision Making

H.B. Fuller sometimes uses the personal data of individuals submitted through the Websites for automated decision-making. For example, H.B. Fuller may display advertisements and send emails to you containing content automatically chosen based on the products you have viewed on the Websites. However, H.B. Fuller will not use your personal data submitted through the Websites or collected offline, in-person for automated decision-making, including profiling, which produces legal effects or which similarly significantly affects you. 

  • Your Rights with Respect to Your Personal Data

Subject to applicable law, you have the right to:

  • request access to your personal data (see also Section 11 above);
  • request that H.B. Fuller update, correct or delete your personal data; and/or
  • withdraw your consent to the processing of your personal data, in circumstances where it was previously provided.

More on the right to withdraw consent: If you consent to the processing of your personal data, you may withdraw your consent at any time by contacting Data_privacy@hbfuller.com.  Any withdrawal shall not affect the lawfulness of processing based on consent before its withdrawal, and H.B. Fuller will continue to retain the information that you provided us before you withdrew your consent for as long as allowed or required by applicable law.  

Subject to applicable law, your country of residence may also provide you with the right to:

  • request restrictions on the processing of your personal data;
  • request data portability; and/or
  • object to the processing of your personal data, including for direct marketing or based on legitimate interests.

More on the right to data portability: Subject to certain limitations, the right to data portability allows you to obtain from H.B. Fuller, or to ask us to send to a third party, a copy of your personal data in electronic form that you provided to us with your consent.

More on the right to object:  You have the right to object to the processing of your personal data for direct marketing purposes or based solely on H.B. Fuller’s legitimate interests.  If you do object in these circumstances, the processing of your personal data will be stopped unless there is an overriding, compelling reason to continue the processing, or the processing is necessary to establish, pursue or defend legal claims.

In a few instances, your country of residence may provide you with additional rights with respect to your data.

How to exercise your rights: You can exercise your rights by submitting a request to Data_privacy@hbfuller.com.  We will respond to such requests in accordance with applicable data protection law. 

If you believe that your personal data has been processed in violation of applicable data protection law, you can contact us at Data_privacy@hbfuller.com.  You may also lodge a complaint with the data protection authority where you live, where you work, or where you believe the violation occurred.

15. Changes to this Privacy Notice  
If we change this Privacy Notice, we will post those changes on this page and update the Privacy Notice modification date below. If we materially change this Privacy Notice in a way that affects how we use or disclose your personal data, we will provide a prominent notice of such changes and the effective date of the changes before making them.
